**Important information regarding HOA Deed Restrictions and Building Permits**

 

Property owners should be aware that they may be impacted by private Deed Restrictions or Covenants that ARE NOT under the jurisdiction of Kent County Government.   Kent County is not authorized to enforce private Deed Restrictions.  However, this does not relieve the property owner from the requirements to maintain compliance with recorded Deed Restrictions.  Deed Restrictions are enforceable through the Civil Court System. 

 

Please contact your Homeowners Association or follow the instructions below to view the documents on the Kent County HOA deeds limited access page:

 

   1.  Go to this website: https://www.uslandrecords.com/delr_hoa/

   2.  Once there, select "Login" at the top of the page and enter the following ID and password - 

                      Login ID:  Kent_hoa           Password:  HOA2012

   3.  This will take you to the document search page.  Search for your development by putting its name in the Business/Last Name

        field.

   4.  This will bring up all of the documents under that name.  Click on the name you wish to view

        (some subdivisions may be under multiple links).

   5.  This page lists all of the documents that apply to HOA's.  Plots are the recorded site plans for the subdivision. 

        Declaration of Restrictions include the rules and regulations for the community that are generally known as Deed Restrictions.

        Deed Miscellaneous includes your HOA bylaws.

   6.  Click on Quick Document Viewer to view the document you chose.

 

Remember that declarations of restrictions and by-laws are often amended and users of the site should be mindful of using the most

recently adopted versions.  In addition, projects approved prior to 2003 were not required to record the HOA by-laws so they

might not be available on the site.
