The BOA meetings are being held in person at the Kent County Complex, but will also still be accessible virtually by phone and video conferencing software. The capacity of the chamber is limited so only a certain number of individuals from the public will be able to attend the meeting in person. If you are not able to attend the hearing in person, you may still provide testimony either for or against the applications listed on the agenda. The Kent County Board of Adjustment, or BOA, serves as the reviewing and decision making body for appeals to the administration of the zoning code; for example, a reduction in setback requirements for a shed. The Board may grant special exception variances from the code consistent with state law. Variance applications are heard by the BOA, and a decision made, on the third Thursday of each month.
The BOA is comprised of 7 (seven) members, one from each Levy Court district. The presence of a quorum (four or more members) is necessary for the Board to take official action on any matter before it for consideration. Their meetings are held at 6:30 p.m. in the Levy Court chambers, room 203 of the Kent County Administrative Complex, 555 Bay Road in Dover, DE, unless otherwise noted.
